Terms of Service

1. Acceptance of Terms

By accessing or using FaxRx ("the Service"), operated by FaxRx LLC, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time, and continued use constitutes acceptance of the updated terms.

2. Description of Service

FaxRx is a cloud-based fax service designed for pharmacies and healthcare organizations. The Service allows users to send and receive faxes electronically, manage contacts, and store fax documents. The Service is provided on a subscription basis with optional credit-pack purchases.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old and have the authority to bind your organization to these terms.

4. Billing and Payment

Subscription fees are billed monthly via Stripe. Credit packs are one-time purchases. All payments are non-refundable except as required by law. If your payment fails, we may suspend access to the Service until payment is received. You are responsible for any taxes associated with your use of the Service.

Credits expire at the end of each billing cycle for subscription-included credits. Purchased credit packs do not expire. We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited faxes (spam) or junk faxes
  • Violate the Telephone Consumer Protection Act (TCPA) or similar laws
  • Transmit illegal, harmful, or fraudulent content
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to other accounts or systems
  • Resell or redistribute the Service without our written permission

6. Healthcare and HIPAA Disclaimer

FaxRx provides a fax transmission service and is not a covered entity under HIPAA. While we implement industry-standard security measures including encryption in transit and at rest, you are responsible for ensuring your use of the Service complies with HIPAA and other applicable healthcare regulations. Enterprise plan customers may request a Business Associate Agreement (BAA) by contacting support@fax-rx.com.

7. Intellectual Property

The Service, including its design, code, and branding, is owned by FaxRx LLC. You retain ownership of all content you transmit through the Service. By using the Service, you grant us a limited license to process and store your content solely for the purpose of providing the Service.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service depends on third-party providers (including fax carriers and payment processors) that may experience outages. We are not liable for delays, failures, or errors caused by third-party services or events beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, FaxRx LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

You may cancel your subscription at any time through your account settings. We may suspend or terminate your account for violation of these terms, non-payment, or at our discretion with reasonable notice. Upon termination, your data will be retained for 30 days, after which it may be permanently deleted.

11. Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
